Administrative structure

On 29 December 2011, the General Council approved Law 23/2011 of 29 December, establishing the Collective Management Society for Copyright and Related Rights of the Principality of Andorra, published in BOPA No. 3, Year 24.
SDADV is a public-law entity with an associative base, its own legal personality, full capacity to act, and the only such organisation in Andorra.

Functions and competences

SDADV’s main function is to manage the economic rights of rightsholders of copyright and related rights, on behalf of and in the interest of those rightsholders, through the corresponding management mandate agreements.

SDADV’s purposes also include contributing to the promotion of creation, culture and artistic performances in general, as well as supporting the preservation and dissemination of the cultural heritage of the Principality of Andorra.

Functions, aims and action plans

The Collective Management Society for Copyright and Related Rights of the Principality of Andorra was established under the law creating SDADV (hereinafter, the SDADV Creation Law). Under that law, SDADV is a public-law entity with an associative base, its own legal personality, and full capacity to act.

SDADV is governed by the SDADV Creation Law, the Copyright and Related Rights Law of 10 June 1999, any laws that may supplement and/or replace them in the future, and the international conventions on the matter ratified by the Principality of Andorra; as well as by its statutes (published in the Butlletí Oficial del Principat d’Andorra, Year 24 - 18 January 2012) and the internal rules duly adopted by its General Assembly or Board of Directors; by the legislation in force on public finances, accounting, and public procurement; and by any other applicable legal or regulatory provisions.

SDADV’s main purpose is to manage the economic rights in copyright and related rights established by the 10 June 1999 law and any law that may supplement and/or replace it in the future, as well as to protect the holders of those rights. SDADV also pursues the following aims:

  1. contributing to the development of creation and the promotion of culture and artistic performances in general;
  2. contributing to the preservation and dissemination of the cultural heritage of the Principality of Andorra and of works and related-rights objects in SDADV’s managed catalogue, together with existing public entities and bodies with similar statutory purposes;
  3. developing welfare activities and services for the benefit of its members;
  4. studying and researching copyright and related rights, and disseminating knowledge and information on these matters;
  5. developing activities to raise social awareness of the importance of respecting copyright and related rights;
  6. collaborating with foreign collecting societies for proper rights management, while always valuing a reasonable balance between works of Andorran origin and works of foreign origin;
  7. collaborating with any other national or supranational organisation related to collective management and the protection of copyright and related rights.

Functions

To achieve its aims, SDADV performs the following functions:

  1. granting authorisations to third parties to carry out acts protected by exploitation rights or exclusive economic rights managed by SDADV; in doing so, SDADV may enter into general agreements with representative user associations in each sector;
  2. collecting fees for the authorisations referred to above and for equitable remuneration or simple remuneration where the applicable legislation provides for it;
  3. distributing amounts collected from users by SDADV among authors and other holders of copyright and related rights involved;
  4. undertaking any legal action necessary to defend and enforce the rights it administers;
  5. establishing a register of performances subject to copyright and related rights managed by SDADV, including references to authors and other rights holders, and issuing certificates of title for successive transactions;
  6. carrying out any other act authorised, in accordance with Article 36 of the 10 June 1999 law, by authors and other rights holders (or their representatives) whose exclusive exploitation/economic rights or rights to equitable/simple remuneration are administered;
  7. carrying out any other task suitable for fulfilling its aims that is not contrary to applicable law or its statutes.

Its budget sets out a budget proposal structured according to the economic classification provided for in the General Public Finance Law and is presented in comparison with the budget approved for the previous financial year.

SDADV’s action programme is set out in its annual report published with CISAC, along with its budget for each financial year.
