In an increasingly interconnected and digital world, protecting creators’ rights is essential. In Andorra, this role is performed by SDADV (Society for Authors’ Rights and Related Rights), a collective management organisation created under Law 23/2011. But what does it really mean to be part of it, and why is it important for creators?
What are copyright (authors’ rights)?
Copyright is the intellectual property right a creator has over their work. These rights allow the creator to decide how their work can be used, reproduced or distributed, and to receive compensation for its exploitation.
The legislation recognises two main categories
- Moral rights: tied to the author’s personality (e.g., the right to be recognised as author, or to object to modifications that could harm the work’s reputation).
- Economic (patrimonial) rights: allow the author to control how the work is exploited and to obtain remuneration. They include rights such as reproduction, distribution, communication to the public, translation or adaptation. Importantly, transfer of rights is not automatic, not even for commissioned works: an explicit contractual clause is required.
What is SDADV’s role?
SDADV’s main mission is to manage the economic rights of authors and artists within the territory of the Principality of Andorra. This management can be done through:
- Direct mandates from authors or rightsholders.
- Reciprocity agreements with other CMOs internationally.
- Works used in Andorra and protected anywhere in the world.
In addition to legal protection, SDADV also:
- Authorises the use of works by third parties through licences.
- Collects royalties generated by the use of works (e.g., in hotels, bars, media…).
- Distributes income equitably among authors.
- Ensures transparent and efficient management of resources.
- Promotes culture and supports artistic creation.
Why is it beneficial for an author to join SDADV?
A major advantage of collective protection is that the author does not have to individually monitor every use of their work. SDADV safeguards their rights and ensures they receive the corresponding compensation.
This protection:
- Encourages creation: knowing your work is protected motivates continued innovation.
- Guarantees fair compensation: authors can earn a living from their creations.
- Fosters cultural diversity: protecting creators protects culture and knowledge for society.
SDADV represents a wide range of creative disciplines:
- Visual and photographic arts
- Audiovisual
- Music
- Literature
- Performing arts
Conclusion
Joining SDADV is not only a smart decision for any author or creator who wants to protect their rights; it is also a way to contribute to the growth and sustainability of Andorra’s cultural sector. Protecting creativity ultimately means protecting the future.
